La Junta estudia recurrir también contra el Estatuto de Castilla y León
Ahora el Duero. Las Cortes de Castilla y León aprobaron anteayer un proyecto de nuevo estatuto de autonomía que recoge en su artículo 70.4 competencias exclusivas sobre ese río, como ya lo hiciera Andalucía con el Guadalquivir.
Eso significaría que los municipios de Robledillo de Gata y Descargamaría, situados al norte de la provincia de Cáceres y pertenecientes a la cuenca hidrográfica del Duero, estarían sometidos a la comunidad castellano-leonesa en ese aspecto.
La Junta de Extremadura anunció ayer que encargará al consejo consultivo un estudio sobre el estatuto castellano-leonés por si procede presentar un recurso de inconstitucionalidad.
El presidente, Guillermo Fernández Vara, admite que en el estatuto de la vecina comunidad del norte la redacción sobre las competencias hidrográficas está «muy matizada» y es diferente a la del texto andaluz, pero el hecho es que figura la palabra ‘exclusiva’ y eso «nos induce a duda».
«Probablemente, si no apareciera la palabra exclusiva no habría ningún problema, pero aparece y eso nos induce a duda, y por esa razón queremos que el consejo consultivo se pronuncie».
El consejo, con sede en Badajoz, está formado por juristas de experiencia y prestigio y su función es asesorar en materias legales de cierta importancia a los órganos políticos de la Comunidad autónoma.
Por «coherencia» con lo que la Junta ha hecho con el estatuto de Andalucía va a estudiar este otro caso.
La Junta de Castilla y León rechazó ayer el argumento del Gobierno extremeño ya que el nuevo texto estatutario «sólo atañe a las aguas que discurren por esta región». Su portavoz, José Antonio de Santiago-Juárez, sostiene que delimita perfectamente en el articulado que las competencias sobre la gestión del Duero se ejercerán sobre aquellas que tengan su nacimiento en Castilla y León y deriven a Portugal «sin atravesar ninguna otra Comunidad Autónoma».
«Que se lo lean»
El conflicto alegado desde Mérida respecto a los municipios cacereños de Robledillo de Gata y Descargamaría no se ajustaría a la letra del nuevo estatuto de autonomía de Castilla y León, por lo que el portavoz de esa comunidad ha recomendado a los responsables extremeños que se lean el estatuto antes de plantearse el recurso.
Una tercera voz, la del secretario regional del PP en Extremadura, César Díez Solís, se ha tomado con «normalidad» la decisión del Gobierno extremeño de pedir un informe sobre la constitucionalidad, aunque ha tachado al PSOE de ser «un auténtico lío» y de no saber qué camino seguir.
En un comunicado el dirigente popular considera que este anuncio se debe tomar con la misma normalidad que hubo con el recurso contra el estatuto andaluz, ya que si el texto es constitucional no existirá ningún problema para su puesta en marcha.
Si no es constitucional, añade, deberá cambiarse para ajustarse a la legalidad, «que es lo que quieren todos los ciudadanos».
